NOTIFICATION : (CORRECTION) IMPLEMENTATION OF THE UPGRADING PROTOCOL OF ASEAN-CHINA FREE TRADE AREA (ACFTA)

With reference to the notification on the Implementation of the revised Rules of Origin Chapter under the ACFTA Upgrading Protocol on 1 August 2019 from Ministry Of International Trade And Industry (MITI).

Kindly be advised that as of today, MITI have not received any official confirmation on the readiness of all Parties to implement the revised ACFTA Rules of Origin on the agreed date of 1 August 2019.

Pursuant to this new development, please be informed of a few updates in the implementation:

i) All approved ACFTA Cost Analysis will maintain its original validity until further notice;

ii) Company may apply Certificate of Origin (Form E) by using existing Cost Analysis as usual and to print on the current pre-printed Form E (FMM);

iii) All new Cost Analysis submission from 27 July 2019 will continue to be evaluated and approved under the current Rules of Origin.

iv) Company wishing to apply Cost Analysis under the new Rules of Origin may do so by putting a remark on the Trader’s Remark section. Be advised that approval for the CA under new Rules of Origin will only be given after the new Rules of Origin entered into force.

In response to the ongoing issue, please be informed that all urgent shipments are to be processed in accordance with the manual SOP until further notice. This, however, remains subject to the discretion of the Royal Malaysian Customs Department (RMCD) and other relevant authorities.
